The privacy policy stipulates in detail the information as regards personal data processing by companies being part of the JP Weber Group.

JP Weber sp. z o.o or another company being part of the JP Weber Group, depending on which of the following JP Weber Group companies has been contacted:

What is the legal basis for your personal data processing?

Should your personal data be processed to:

  • Execute an agreement or undertake actions with a view to concluding an agreement – the legal basis allowing the lawful processing of your personal data is Art. 6(1)(b) of the GDPR – the indispensability of data for the performance of an agreement to which the data subject is party or in order to take steps at the request of the data subject prior to entering into an agreement.
  • Provide legal services, deliver tax advisory and accounting services, render HR and payroll services, and to provide investment advisory services – such data is processed pursuant to Art. 6(1)(b) of the GDPR, i.e., to execute an agreement to provide legal services, deliver tax advisory and accounting services, render HR and payroll services, provide investment advisory services, and also pursuant to Art. 6(1)(f) of the GDPR, i.e., to pursue a legitimate interest by the controller or by a third party consisting in pursuing claims, indemnifying against claims as well as obtaining legal and tax support.
  • Establish and maintain business contacts, and direct marketing – personal data for business contact purposes is processed pursuant to Art. 6(1)(f) of the GDPR, i.e., to pursue a legitimate interest consisting in promoting the JP Weber brand and conducting business operations.
  • Gather statistics on jpweber.com website hits – personal data for business contact purposes is processed pursuant to Art. 6(1)(f) of the GDPR, i.e., to pursue a legitimate interest consisting in conducting analyses of our website visits and to adapt its functionality to the users’ preferences.
  • Send a  newsletter – personal data is processed on the basis of your consent, i.e., pursuant to Art. 6(1)(a) of the GDPR.
  • The recruitment process – to the extent stipulated in Art. 22(1) of the Polish Labour Code, your personal data is processed pursuant to Art. 6(1)(c) of the GDPR, i.e., processing is necessary for compliance with a legal obligation to which the controller is subject, and to another extent – pursuant to  Art. 6(1)(a) of the GDPR, i.e., your consent to the processing of your personal data.
  • Fulfil obligations arising from the provisions on anti-money laundering and countering the financing of terrorism -  your personal data is processed pursuant to Art. 6(1)(c) of the GDPR, i.e., processing is necessary for compliance with a legal obligation to which the controller is subject. The legal obligation in this case is the application of financial security measures consisting in the identification and verification of the identity of a client and a real beneficiary as stipulated in the AML provisions.

The following entities, being part of the JP Weber Group with its registered office in Wrocław at  ul. Rynek 39/40, 50 -102 Wrocław, may be the recipients of your personal data:

  • JP Weber Accounting & Tax sp. z o.o.

as well as entities collaborating with JP Weber Group companies, including IT and courier businesses, translation, and notarial offices.  

For how long do we store your personal data?

Should your personal data be processed to:

  • Execute an agreement or undertake actions with a view to concluding an agreement – your personal data shall be stored until the said activities are concluded or until the agreement is terminated, and subsequently for the period of limitation of any claims arising therefrom;
  • Render legal or tax services – your personal data shall be stored for a period of 10 years following legal proceedings becoming final and absolute, or the cessation of the rendering of legal services in those matters;
  • Establish and maintain business contacts, and direct marketing - your personal data shall be stored for the period our business relations are maintained or until you object to the processing of your personal data pursuant to Art. 21 of the GDPR;
  • Send a newsletter – your personal data shall be stored until your resign from the Newsletter service;
  • The recruitment process – your personal data shall be stored for a period necessary to pursue the purpose for which it has been collected – in case the consent was granted for the purpose of a single, specific recruitment process – your personal data shall be erased within 7 days following that recruitment process – in case the consent was granted for the purpose of subsequent recruitment processes – your personal data shall be erased upon the lapse of time for which the consent was granted;
  • Gather statistics on www.jpweber.com website hits - your personal data in the form of an IP address shall be stored for a period of 5 years;
  • Fulfil obligations as regards anti-money laundering and countering the financing of terrorism - your personal data shall be stored for the period specified in the Act on countering money laundering and the financing of terrorism, i.e., for a period of 5 years from the first day of the year following the year in which economic relations with a client with whom transactions were conducted from time to time. 

What are your rights?

GDPR provides for an array of rights you are entitled to as regards personal data processing by the controller.

You have the right to:

  • request the controller to grant access to your personal data, to rectify it, erase it or to restrict the processing thereof,
  • have your data transmitted,
  • revoke consent to personal data processing – in case the data is processed pursuant to Art. 6(1)(a), i.e., your consent; revoking consent for the personal data processing does not affect the legality of data processing on the basis of a given consent prior to its performance,
  • object to data processing - in case the data is processed pursuant to Art. 6(1)(f) of the GDPR, i.e., our legitimate interest,
  • lodge a complaint to a supervisory authority - the President of the Personal Data Protection Office.

What are the consequences of the non-provision of data? 

Please be assured that your personal data is processed only to the extent necessary to pursue the purpose for which they were collected. Providing your data is voluntary, and the non-provision thereof may preclude the purpose for which they are collected from being pursued.
